Terms of service.

Plain-language terms for ordering an EyeJoy. The studio is operated by Mad Growth BV, Amsterdam.

Who we are

EyeJoy is a trading name of Mad Growth BV, registered in Amsterdam, the Netherlands — Chamber of Commerce (KvK) 87186136, VAT (BTW) NL004370105B09. By placing an order you agree to these terms.

What you’re buying

The €29 digital pack: your finished artwork as a high-resolution file on black and on white, plus a phone wallpaper in each. Four files, delivered as downloads and by email. Printing, framing, physical shipping, and scheduled gift delivery are not included.

Prices and VAT

Prices are shown in euros and include VAT. For a digital product, VAT is charged at the rate of the country you’re in, under the EU rules for digital services — the price on the page is the price you pay. Your Stripe receipt is your proof of purchase.

Ordering and payment

Payment is taken at checkout, through Stripe. Your card details go straight to Stripe; we never see them. Your order exists from the moment payment is confirmed.

Previews, and what a render costs you

Nobody buys unseen. Before you pay anything, the app renders your artwork and shows you a watermarked preview of it — that preview is the piece, and you decide from there. Payment removes the watermark and unlocks the four files for that render.

Rendering is automatic; there is no human proof review. Because each render costs us real money at an image provider, they are counted: without an account you get one free render, signing in gives you more, and buying gives you plenty more. If a render fails for a technical reason your credit is given straight back, so a failure on our side never costs you an attempt. If your photo simply didn’t work and you’re stuck, write to the studio — we’ll help you get to a render you’re happy with.

Digital delivery

The digital pack is delivered through the confirmation and download screens as soon as payment is confirmed, and by email to the address you gave at checkout. Those links stay yours.

Your right of withdrawal — and how you waive it

As a consumer in the EU you normally have 14 days to withdraw from a distance purchase without giving a reason.

Digital content delivered immediately is the exception. When you buy the pack you ask us to deliver it right away and tick the box confirming you agree to immediate performance and accept that you lose your right of withdrawal once the download begins. That waiver is the law’s own condition for instant delivery — Article 16(m) of the Consumer Rights Directive, Article 6:230p of the Dutch Civil Code.

In plain terms: tick the box, start downloading, and the 14 days are gone. Don’t tick it and we’ll hold delivery until the 14 days have passed. Either way, this changes nothing about a file that is broken or that we can’t supply — see below.

Download problems and refunds

If a paid file cannot be downloaded or is technically defective, contact us and we will restore the download, replace the file, or refund the order where we cannot provide the purchased digital pack. Statutory consumer rights remain unaffected.

Complaints

Something wrong? Write to hello@eyejoy.art with your order number or the email you used at checkout. We aim to reply within one business day, and you’ll always have a considered answer within 14 days.

If we can’t resolve it between us, consumers in the Netherlands can turn to ConsuWijzer (the ACM’s consumer information desk), and consumers elsewhere in the EU can contact their national European Consumer Centre. The EU’s online dispute resolution platform closed on 20 July 2025 and is no longer available. We’d much rather sort it out directly.

Your artwork and rights

The finished artwork is yours to keep, display, print for yourself, and gift. We retain the rights to our rendering pipeline, brand, and the methods used to create it. We may show anonymised pieces in our gallery only with your permission.

Your photo and privacy

Your source photo is used only to make your artwork. It is never written to disk or to our database. The full detail — processors, legal bases, retention, your rights — lives in our privacy policy.

Acceptable use

Upload only photos you have the right to use. For a gift-flow order, the recipient uploads their own photo. Don’t use the service to create artwork from someone’s image without their knowledge.

Liability

Our liability for any order is limited to the amount you paid for it. Nothing in these terms limits rights you have under applicable consumer law.

Governing law

These terms are governed by the laws of the Netherlands. As a consumer you keep the protection of the mandatory rules of the country you live in.
